General Terms and Conditions

1. Scope of Application

These General Terms and Conditions apply to all offers, deliveries and services provided by
AlphaZaun – Dieter Goißer (hereinafter referred to as the “Contractor”).

Any deviating terms of the client shall only apply if expressly confirmed in writing by the Contractor.

2. Offers and Conclusion of Contract

All offers are non-binding and subject to change.
A contract is concluded only upon written confirmation or commencement of the service.

Custom-made products are manufactured exclusively based on the agreed specifications and dimensions.

3. Prices and Scope of Services

All prices are stated in Euro unless otherwise agreed.

Unless explicitly included, the following are not part of the offer:

• preparatory work

• foundation work

• additional services required on site

Changes requested after order confirmation may result in additional charges.

4. Terms of Payment

Unless otherwise agreed:

• deposit upon order confirmation

• remaining balance upon delivery or after installation

In case of delayed payment, the Contractor reserves the right to suspend work.

5. Obligations of the Client

The client shall ensure that:

• access to the site is possible

• the working area is cleared

• all necessary permits are obtained

• correct measurements and information are provided

Delays or additional costs caused by missing or incorrect information shall be charged separately.

6. Measurement and Basis of Work

Measurements are taken carefully on site.

Adjustments may be necessary due to:

• uneven terrain

• structural conditions

• Subsequent changes

7. Delivery and Performance Time

Delivery and execution times are non-binding unless explicitly agreed otherwise.

Delays caused by:

• weather conditions

• material shortages

• unforeseen circumstances

do not entitle the client to claims for damages.

8. Installation

Installation is carried out professionally.

The Contractor assumes no liability for existing structures if they are:

• unsuitable

• damaged

• not load-bearing

Additional work required on site will be charged separately.

9. Transfer of Risk

The risk passes to the client upon delivery of the goods or commencement of installation.

​

10. Default of Acceptance

If installation cannot be carried out due to reasons attributable to the client, the Contractor is entitled to:

• charge incurred costs

• reschedule the appointment

• charge storage costs if necessary

 

11. Retention of Title

All delivered goods remain the property of the Contractor until full payment has been received.

12. Warranty

Statutory warranty provisions apply.

No defect shall be deemed to exist in case of:

• minor deviations in dimensions

• visual deviations

• weather-related changes

• normal wear and tear

Custom-made products are excluded from return.

13. Right of Withdrawal

There is no right of withdrawal for custom-made products in accordance with applicable consumer protection laws.

14. Liability

The Contractor shall only be liable for damages caused by gross negligence or intent.

No liability is assumed for indirect or consequential damages.

​

15. Changes and Additional Services

Subsequent changes or additional requests shall be agreed separately and charged accordingly.

16. Data Protection

The processing of personal data is carried out in accordance with the privacy policy available on this website.

​

17. Jurisdiction and Applicable Law

Austrian law shall apply.

The place of jurisdiction is the competent court at the Contractor’s registered office.

18. Severability Clause

Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
The invalid provision shall be replaced by a legally permissible provision that most closely reflects the intended economic purpose.
